We engage contacts via channels like SMS, email, and social media DMs, booking qualified appointments on behalf of our clients. Our services focus on lead follow-up and appointment scheduling — we do not sell your product or represent your brand in negotiations.
2. Eligibility
You must be at least 18 years old and authorized to enter into binding contracts on behalf of your business or organization. By using our Services, you confirm you meet these requirements.
3. Service Scope
Our responsibilities include:
Creating and running AI-based lead follow-up sequences
Engaging old or inactive leads provided by you
Booking appointments with leads who show interest
Your responsibilities include:
Providing accurate and complete lead lists
Ensuring the leads you provide have consented to be contacted
Attending booked appointments and handling sales/closings
We reserve the right to refuse or terminate service if lead sources are found to be unethical or violate applicable laws.
4. Fees & Payment
We offer several pricing models, including:
Performance-based pricing: Pay-per-booked appointment
Retainer model: Fixed monthly fees
Hybrid model: A base fee + pay-per-appointment
You agree to pay all fees in accordance with the plan outlined in your agreement or invoice. Late payments may incur interest and service suspension.
5. No Guarantees
While we strive to improve your lead conversion, we do not guarantee specific business outcomes, such as revenue or closed sales. Our responsibility ends with delivering qualified appointments.
6. Intellectual Property
All content, tools, and strategies developed by Orbyx, including our outreach scripts, systems, and workflows, remain our intellectual property. You may not copy, distribute, or resell any proprietary materials without written permission.
7. Acceptable Use
You agree not to:
Upload or submit lead lists that were obtained without consent
Use our Services for unlawful or deceptive purposes
Attempt to reverse-engineer, scrape, or misuse our platform
Violations may result in immediate termination of service and possible legal action.
8. Confidentiality
We will keep your business information and lead lists confidential and secure. You agree to do the same for any proprietary tools, scripts, or outreach methods we share with you.
9. Termination
Either party may terminate the service at any time with written notice. You are responsible for payment for any services already rendered or appointments booked prior to termination.
10. Disclaimer & Limitation of Liability
The Services are provided “as-is” and “as available.” We disclaim all warranties, express or implied. Orbyx is not liable for lost profits, data loss, or indirect damages arising from the use of our Services.
11. Governing Law
These Terms shall be governed by the laws of the State of Texas, without regard to its conflict of law principles. Disputes shall be resolved in the courts located in Hays County, Texas.
12. Updates to These Terms
We may update these Terms from time to time. If we make material changes, we’ll notify you by email or via the platform. Continued use of the Services after changes go into effect constitutes your acceptance.
